KAMA SHOETRA — TERMS AND CONDITIONS

1. SERVICE AGREEMENT
By using the services of Kama Shoetra (Pty) Ltd ("the Company"), you ("the Customer") agree to the following terms. These terms apply to all services including cleaning, restoration, and any future marketplace or subscription services.
2. SCOPE OF SERVICES
The Company provides professional shoe and equipment cleaning, restoration, and care services at our Sandton location (1 Kikuyu Rd, Moove Gym, Sunninghill, 2157). Services include but are not limited to:
- Full sneaker wash and cleaning
- Sports gear cleaning (boxing gloves, shin guards, cleats, helmets)
- Golf equipment cleaning
- Shoe restoration and recolouring
- Corporate bulk cleaning deals
3. AI-POWERED INSPECTION
- Each item is photographed and assessed using AI technology upon intake.
- AI inspection determines the condition, material type, dirt severity, and recommended services.
- Items assessed as heavily soiled may incur a surcharge of up to 20%, which will be disclosed before proceeding.
- AI inspection results are stored against the order for quality assurance and dispute resolution.
4. CUSTOMER RESPONSIBILITIES
- Disclose any known defects, damage, or special care requirements at drop-off.
- Items are left at the Customer's own risk during the service period.
- Collect items within 14 days of notification that services are complete.
- Items uncollected after 30 days may be donated or disposed of at the Company's discretion.
5. COMPANY RESPONSIBILITIES
- Exercise reasonable care and skill in performing agreed services.
- Photograph and AI-inspect each item upon receipt, noting pre-existing conditions.
- Use appropriate cleaning methods and products for each material type.
- Aim to complete services within 24–48 hours, though this is not guaranteed and depends on workload and item condition.
6. LIABILITY
- The Company is not liable for pre-existing damage, wear, or natural deterioration.
- The Company is not liable for colour changes or material reactions that may occur during normal cleaning.
- Maximum liability for any item shall not exceed the declared value or R5,000 (whichever is lower).
- The Company is not responsible for items left uncollected after 30 days.
7. PRICING AND PAYMENT
- Prices are as quoted at the time of order and are inclusive of VAT.
- Payment may be made at drop-off or upon collection ("Pay on Collection").
- Surcharges for heavily soiled items will be communicated before proceeding.
- Additional services identified during inspection require Customer approval.
- Promotional pricing and bundle deals are subject to availability and may change without notice.
8. TURNAROUND TIME
- Standard turnaround is 24–48 hours from drop-off. This is an estimate and not a guarantee.
- Turnaround may vary based on workload, item condition, and services required.
- Restoration services may take 3–7 business days depending on complexity.
- The Company will notify the Customer of progress and any delays via WhatsApp or phone.
9. DISPUTE RESOLUTION
- Disputes must first be raised directly with the Company within 7 days of collection.
- Before/after AI inspection photos serve as evidence of item condition.
- If unresolved, disputes may be referred to mediation in accordance with South African law.
10. PRIVACY AND DATA PROTECTION (POPIA COMPLIANCE)
In accordance with the Protection of Personal Information Act (POPIA):
- Personal information (name, phone number, email) is collected solely to provide services and communicate with you.
- Photographs of items are taken for quality assurance, AI inspection, and dispute resolution.
- We will not share your personal information with third parties without your consent, except as required by law.
- You may request access to, correction of, or deletion of your personal data by contacting us at 068 614 3596 or visiting our premises.
- Marketing communications will only be sent with your opt-in consent and you may unsubscribe at any time.
11. MOBILE APP AND DIGITAL SERVICES
- When available, the Kama Shoetra mobile app provides order tracking, rebooking, and pickup/delivery services.
- Pickup and delivery services are limited to a 20km radius of our Sandton location.
- Digital services are subject to separate terms which will be presented within the app.
12. MARKETPLACE (COMING SOON)
- The Kama Shoetra marketplace will allow verified users to buy and sell pre-owned shoes.
- All marketplace items must be cleaned and verified by the Company before listing.
- The Company acts as an intermediary and does not guarantee the condition of third-party items beyond the cleaning service provided.
- Marketplace terms will be published separately when the service launches.
13. INTELLECTUAL PROPERTY
- The Kama Shoetra name, logo, and brand elements are the property of the Company.
- Before/after photos of items may be used for marketing purposes. Customers may opt out at the time of drop-off.
14. AMENDMENTS
The Company reserves the right to amend these terms. Updated terms will be available at our premises and on our website (kamashoetra.com/disclaimer).
15. GOVERNING LAW
These terms are governed by the laws of the Republic of South Africa.
